SMS Terms and Conditions (Text Messaging Terms of Service)
Produce Express LLC SMS Program Terms Effective Date: April 2026
These SMS Terms and Conditions ("SMS Terms") govern your participation in the Produce Express LLC ("we," "us," or "our") text messaging program. By signing up (via our website form or by texting a keyword to join), you agree to these SMS Terms and our Privacy Policy. If you do not agree, do not sign up or reply to our messages.
1. Program Description
Our SMS program allows you to receive recurring automated text messages, including:
- Flash sale alerts and other marketing/promotional messages
- Account balance details
- Customer support replies
Message frequency varies (typically a few messages per month, but can be more during promotions). We may use automated systems to deliver messages. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
2. Opt-In and Consent
You may opt in by:
- Completing a form on our website and checking the consent box, or
- Texting a designated keyword to our number.
By opting in, you provide your prior express written consent to receive recurring automated promotional and informational text messages from Produce Express LLC at the mobile number you provide. Consent is not a condition of purchase. You represent that you are the account holder or have permission from the account holder to enroll that number, and that you are at least 18 years of age.
3. Opt-Out
To stop receiving messages, reply STOP to any text we send. We will process your opt-out promptly and send one confirmation message. After opting out, you will no longer receive messages from us (except as needed to confirm the opt-out).
You may also opt out by contacting us directly (see Contact section below). Note that opting out of SMS does not affect other communication channels (e.g., email) unless you separately unsubscribe from those.

5. Group Texting and MMS
We may occasionally use group texting or send multimedia (MMS) messages (e.g., with images of produce or promotions). Standard message and data rates apply to MMS.
6. Limitations and Disclaimers
- We reserve the right to modify or discontinue the SMS program at any time without notice.
- We are not responsible for any delays, failures, or costs associated with text messaging, including carrier fees.
- Limitation of Liability: To the fullest extent permitted by law, Produce Express LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your participation in the SMS program. Our total liability shall not exceed the amount you paid us in the twelve months prior to the claim (if any).
- Governing Law: These SMS Terms are governed by the laws of the State of Utah, without regard to conflict of laws principles.
7. Changes to These Terms
We may update these SMS Terms. We will post the revised version on our website. Your continued participation after changes constitutes acceptance.
